Avviso importante

1. Introduzione e accettazione

3. Eligibility and Account Requirements

3.1 Age Requirement

You must be at least 18 years old to use the Platform.

3.2 Account Accuracy

You agree to:

  • Provide accurate and complete information
  • Keep your account information updated
  • Maintain the security of your password
  • Accept responsibility for all activity under your account
  • 3.3 One Account Per Person

Each individual may maintain only one account. Creating multiple accounts may result in termination.

    3.4 Business Accounts

Providers may register as individuals or businesses. Business accounts must provide accurate business registration information where required.

    4. Platform Description

    4.1 Marketplace Model

LinkUp is a neutral marketplace that:

  • Allows Customers to post service requests
  • Allows Providers to browse and respond to requests
  • Facilitates communication between Customers and Providers
  • Processes payments securely via Stripe
  • 4.2 What LinkUp Does NOT Do

    LinkUp does not:

  • Employ, supervise, or direct Providers
  • Guarantee the quality, safety, or legality of services
  • Vet or verify all claims made by Users
  • Provide insurance or warranty for services
  • Set prices for Providers (Providers set their own prices)
  • Assign jobs to Providers (Providers choose which jobs to respond to)
  • 5. Customer Terms

    5.1 Posting Requests

Customers may post service requests ("Jobs") by:

  • Describing the service needed
  • Specifying the location
  • Indicating budget range (optional)
  • Providing relevant details and photos
  • 5.2 Receiving and Accepting Offers

  • Providers may send offers in response to your Job
  • You may communicate with Providers via the Platform
  • You choose which offer to accept (if any)
  • Accepting an offer creates a direct agreement between you and the Provider
  • 5.3 Payments

All payments are processed securely via Stripe:

  • Payment Timing: Payment is collected when you accept an offer
  • Price and Card Processing Fee: You pay the agreed price plus a card processing fee. The fee passes on the cost of processing your card payment, as charged by our payment provider. It is shown in full, in CHF, before you pay, and it is not a LinkUp commission (see section 8.2)
  • Payment Release: Payment is released to the Provider after you confirm that the Job is complete, or after it is confirmed automatically as described below
  • Currency: All transactions are in Swiss Francs (CHF)
  • Automatic confirmation. If the Provider marks the Job complete and you neither confirm nor open a dispute within 14 calendar days, we will confirm on your behalf and release the payment to the Provider. We send you reminders before that date. The 14 days run from the day the Provider marks the Job complete. Automatic confirmation does not run while a dispute or a refund is open for the Job. It is not a statement that the work was done to your satisfaction, and it does not affect any right you have against the Provider under Swiss law.

LinkUp does not store your credit card details. Card information is handled directly by Stripe.

    5.4 Cancellations

  • You, or the Provider you hired, may cancel a Job until the Provider marks it complete. Once the Provider has marked the Job complete it can no longer be cancelled
  • If you had already paid, that payment is refunded to you in full (the agreed price and the card processing fee) — see section 8.3
  • After the Provider marks the Job complete, your route is a dispute (see section 11): open one before you confirm the Job and before it is confirmed automatically (see section 5.3)
  • Cancelling does not settle what you may owe the Provider for work already done. That is a matter between you and the Provider, and we ask you to agree it with them before cancelling
  • Disputes: If something goes wrong, contact support and we'll help coordinate next steps
  • 5.5 Reviews

After a job is completed, you may leave a review for the Provider. Reviews must be:

  • Honest and based on your actual experience
  • Free from harassment, discrimination, or false claims
  • Relevant to the service provided
  • 6. Provider Terms

    6.1 Independent Contractor Status

    CRITICAL LEGAL NOTICE:

Providers are independent contractors, not employees of LinkUp.

    As an independent contractor, you:

  • Control your own schedule and working hours
  • Set your own prices and terms
  • Choose which jobs to respond to (no obligation to accept any lead)
  • Provide your own tools, equipment, and materials
  • Are responsible for your own taxes and insurance
  • May work with other platforms or clients simultaneously
  • LinkUp does not:

  • Require you to accept any job
  • Penalize you for declining or ignoring leads
  • Set your working hours or schedule
  • Supervise how you perform services
  • Provide training or equipment
  • 6.2 Credit System

  • Providers use credits to access and respond to leads
  • Credits are purchased or included in subscription plans
  • Credit usage does not guarantee you will win the job
  • Unused credits do not expire unless your account is terminated
  • 6.3 Subscriptions

    Provider subscription tiers may include:

  • Monthly credit allocations
  • Enhanced profile visibility
  • Additional features
  • Subscription terms are detailed at the time of purchase.

    6.4 Offers and Communication

  • You may browse available jobs in your service area
  • You may submit offers to jobs you're interested in
  • Communication with Customers should be professional
  • You are never obligated to submit an offer or accept work
  • 6.5 Payments to Providers

  • Payment is released after the Customer confirms that the Job is complete, or automatically as described next
  • If the Customer does not respond, the Job is confirmed automatically 14 calendar days after you mark it complete and the payment is released then, unless a dispute or a refund is open. The Customer is sent reminders before that date
  • LinkUp deducts its platform commission from your payout (see section 8.2)
  • Payments are made to your connected Stripe account
  • You are responsible for providing accurate payment information
  • You are responsible for your own tax reporting and compliance
  • 6.6 No Employment Relationship

Nothing in these Terms creates an employment, partnership, joint venture, or agency relationship between you and LinkUp. You acknowledge that you are engaged in your own independent business.

    7. Prohibited Conduct

    All Users agree NOT to:

    CategoryProhibited Actions
FraudFalse information, fake reviews, identity misrepresentation
    HarassmentAbusive language, threats, stalking, discrimination
    SpamUnsolicited messages, promotional abuse
CircumventionTaking transactions off-platform to avoid fees
Illegal ActivityServices or conduct that violate applicable law
ManipulationFake accounts, review manipulation, system abuse
Data MisuseHarvesting user data, unauthorized access

Violations may result in account suspension or termination.

    8. Payments and Fees

    8.1 Payment Processing

All payments are processed by Stripe. By using payment features, you agree to Stripe's terms of service.

    8.2 Platform Fees

  • Platform commission: LinkUp retains a platform commission of 5% of the agreed job price. The commission is deducted from the payout to the provider; customers pay only the agreed price plus the card processing fee shown at checkout.
  • Card processing fee: this fee passes on the cost of processing a card payment, as charged by our payment provider. It is added to the agreed price, shown in full before you pay, and is not a LinkUp commission.
  • Provider Fees: As specified in subscription/credit pricing
  • 8.3 Refunds

There is no separate refund policy document. These are the rules:

  • When a refund is issued: if you have paid for a Job and it is cancelled, that payment is refunded. You or the Provider may cancel until the Provider marks the Job complete (see section 5.4); after that the Job can no longer be cancelled and your route is a dispute (see section 11).
  • How much: the full amount you paid for the Job, that is the agreed price and the card processing fee. Refunds are made to the payment method you used.
  • After release: once the Job has been confirmed complete, by you or automatically, and the payment has been released to the Provider, LinkUp can no longer reverse it. Contact support and we will help coordinate with the Provider, but the outcome is then a matter between you and them.
  • While a dispute is open: we do not release the payment to the Provider until the dispute is resolved (see section 11), and automatic confirmation does not run.
  • Timing: Stripe returns the money to your original payment method. How long it then takes to appear on your statement is set by your bank, not by LinkUp.
  • Credits: this section covers Job payments. Credits bought by Providers are not refunded on request; if a credit purchase was charged in error, contact support.
  • Nothing in this section limits rights you have under mandatory Swiss law.
  • 8.4 Taxes

Users are responsible for their own tax obligations. LinkUp may be required to report certain transactions to tax authorities.

    9. Content and Intellectual Property

    9.1 User Content

You retain ownership of content you post (photos, descriptions, reviews). By posting, you grant LinkUp a non-exclusive, worldwide license to display and use this content on the Platform.

    9.2 Acceptable Use

    User content must not:

  • Infringe intellectual property rights

  • That Providers are licensed, insured, or qualified
  • The accuracy of information provided by Users
  • That the Platform will be error-free or uninterrupted
  • 10.3 Limitation of Liability

To the maximum extent permitted by law, LinkUp's liability is limited to the amount you paid to LinkUp in the 12 months preceding the claim.

    LinkUp is not liable for:

  • Actions or omissions of Providers or Customers
  • Disputes between Users
  • Indirect, incidental, or consequential damages
  • Lost profits or data
  • 10.4 Provider Insurance

Providers are strongly encouraged to maintain appropriate business liability insurance. LinkUp does not provide insurance coverage for services performed.

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any law or third-party rights
  • Services you provide or receive through the Platform
  • 11. Dispute Resolution

    11.1 Between Users

If a dispute arises between a Customer and Provider:

  • Attempt to resolve directly through Platform messaging
  • Contact LinkUp support for assistance
  • We may facilitate communication but are not obligated to resolve disputes
  • While a dispute is open, the automatic confirmation described in section 5.3 does not run.

  • If unresolved, mediation may be attempted
  • Legal proceedings must be brought in Swiss courts
  • 11.3 Governing Law and Jurisdiction

  • Data is retained as described in our Privacy Policy
  • Certain provisions of these Terms survive termination
  • 13. Changes to Terms

We may modify these Terms at any time. We will:

  • Post updated Terms on this page
  • Update the "Last Updated" date
  • Provide 30 days' notice for material changes
  • Continued use after changes constitutes acceptance. If you disagree, stop using the Platform.

    14. General Provisions

    14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and LinkUp.

    14.2 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

    14.3 No Waiver

Failure to enforce any right does not waive that right.

    14.4 Assignment

You may not assign your rights under these Terms. LinkUp may assign its rights to a successor.

    14.5 Language

These Terms are drafted in English. We may provide translations into German, French or Italian for your convenience. In the event of any discrepancy between the English version and a translation, the English version prevails. This does not affect any mandatory rights you have under Swiss law.
